A a consequence of Brexit, I understand that a U.K. passport holder can only stay for 90 days in Spain. We have been here since before Christmas and plan to return to the U.K. on March 28th.  So just over 90 days in total. Is anyone certain that we will be penalised, and if so in what way?  Could we avoid a penalty as a consequence of no direct flights for example?

Any advice would be much appreciated.

Hi. I don't think there's a penalty but you will probably need a PCR to travel back to England. If you don't have the PCR then it's very awkward to fly unless your vaccinated . If not you need to phone your doctor's here and have a residencia or your medical card,  you maybe able to get vaccinated depending on your age but it's worth a try. I'm a live in carer in England and here for a few weeks and I thought it better to get it here so I don't have all the problems of isolation and travel. They will ring me tomorrow when there's a space to have it done. I'm not keen on having it done but I think It will stop all the problems with traveling and not needing the PCR within a few hours .

It seems to be a very grey area at the moment: theoretically, if you exceed the 90 days you could be liable to a fine or even banned from the country in question. Eventually I believe your passport will be able to log the number of days you are in a country. The 90 day rule has no bearing on the vaccination programme. Reading between the lines I think the Spanish government may come to a 'sidebar' deal with the UK over length of stay: the British residents and those with second homes contribute an enormous amount to the Spanish economy. Check with your airline: easyJet, for instance, has had very clear information over the last year concerning the pandemic and restrictions.

Hi. Can you not get the residencia card. If you have a home already here then you can take the Certificado de Empadronamiento which you get from your local area. The Ayuntamiento which will say your proof of address , so you can continue from there.  You need to book online though to get a time to go in.  Do you want a residencia ?

If you want Residencia then you must declare Spain as your main residence. You also have to provide proof of a certain  amount in the bank (I think its @ £22000 per person), and regular income or pension. The spanish government will then tax you on your UK assets including property.

I believe the 90 days will be counted from 1st January so you have until the end of March. At present, Spain is not on the red list so you would require a PCR or LAMP test not more than 72 hours of departure but before you depart from Spain, you will have to book a test for your 2nd day and 8th day of arrival in the U.K. and quarantine for 10 days. This has to be booked through the government portal as it needs to be entered on your Passenger Locator Form to allow you to board the plane.  

Anyone feel free to correct me if this is wrong.

I don't know about the money thing but if you have a property it's best to have a residencia.  If you change your English passport to a Spanish one then that's different.  When I work in England I pay England because I'm working there but if there's no work in Spain then how do the bills get paid ? If you've never had a recidencia then it might be more difficult to get one . You must have some proof to prove your entitled to be in your residential home here even if it's long or short term.  I think people are being ripped off by someone out there if they have to have  alot of money in the bank . Even the Spanish don't have 20,000. They rely on tourism without a descent contract to work so they can't even get money in the winter either.

I stand corrected by Tamara. I have had a property on Menorca for 36 years, we visit for about 3 months every year, but not once has anyone, or my Mahon solicitor, raised the question of Residencia. I obviously pay Wealth and Property taxes to the Mercadal administration. Perhaps I have been poorly advised.

You have to spend 183 days a year in Spain to be eligible for residencia and then have to declare your worldly assets for tax purposes.
