Residency in Menorca

We have owned a property in salgar for 24 years, which we use as a holiday home. We usually spend 5 to 6 months a year here but obviously with Brexit that will not be possible. We would like some advice on which documents we need to complete that will allow us to remain U.K. citizens and pay our taxes there but be able to spend more than 3 months in Menorca after December 2020, please

Hi. I can't see how they will know how long your staying for. If they ask you just say your on holiday but who will ask you ?

Hi, our understanding is this; if we want to stay in Menorca whether in our own home or any property for more than 3 months at a time we should by Spanish rules apply for a Residencia card. Please correct me someone if I am wrong! Also, I understand that if we apply and get a Residency card we are then abliged by Spanish rules to fill in a tax return in Menorca. I also understand that if we stay in Menorca for 1 day more than 6 months we are deemed Fiscal Residents or Tax Residents in Spain and therefore have to declare our worldly possions and pay tax in Spain. If anyone wants to correct my understanding of all of this, I would be delighted to hear. I think there are many worried people wanting to do the right things and get on enjoying life!

Hi thank you for your response but if it was that easy wouldn’t all U.K. citizens just carry in doing that instead of treading a minefield to try and sort some kind of residency status out

Thank you for your reply, it’s so confusing, what is the difference between being a resident and a fiscal resident,  is it possible once you become a resident to carry on paying taxes in the U.K.

I explored this a few months ago. I was told by an accountant in Menorca that if I became resident in Menorca then I submit my tax return in Menorca and pay taxes to Spain.

If you become resident you also need to have a Spanish driving license.

A friend of mine who is resident in Menorca said that unless you are intending to make Menorca your home, then it is not worth it.

My understanding from what I have read is that we will be able to stay 3 months out of 6 months.

My hope is that there may be a system established similar to America where you could stay for 3 months unless you have a visa in which case you can stay 6 months out of 12

It will all be linked electronically to our passport similar to the Esta visa visitors sytem used in America.

An esta has to be renewed every two years. No esta you don’t get in.

I was told I could never have a proper card issued because I was a stranger. They issued me a piece of green paper with the DNI on it and an old address I had. 10 years.  I tried to update it so I could have a proper residencia like my daughter has as she was born here but they said they can't because I'm a stranger so the green piece of paper has to be used with your English passport if you want to get a cheaper flight with vueling to Mallorca or Barcelona.  That is what's it worth, nothing else really.

Hi, we haven't heard of a temporary residency. That would be fab for us all! I think that you can give up your residency when you like by taking it to the town hall. I do think though it would be harder to get it again! If you had a 'temporary residency', it's almost like making up our own rules to suit ourselves. That would also be great! It is relatively straightforward to obtain a residency this side of the year. Next year there will be loads more hoops to jump through just to be able to come and enjoy the properties that we all love so much. It is such a shame that Brexit is happening at all, but that's life!
